These Terms of Service ("Terms") govern your use of guzmanapplied.com (the "site"), operated by Guzman Applied Technologies ("GAT," "we," "us"), a sole proprietorship operated by Edwin Guzman based in California, USA. By accessing or using the site, you agree to these Terms. If you do not agree, do not use the site.
What the site is
guzmanapplied.com is an informational and marketing site for a business-to-business consulting practice. The site exists to describe services, publish writing and case studies, and let prospective clients reach out. The site does not provide consulting services itself. Reading the site does not create a consulting relationship, an attorney-client relationship, a fiduciary relationship, or any other professional relationship.
No service relationship until a signed engagement
No engagement, retainer, or service relationship is created by browsing the site, submitting a contact form, booking a call, exchanging emails, or signing a Non-Disclosure Agreement. A consulting engagement exists only when both parties have signed a written engagement letter or scope-of-work document that explicitly creates one.
Until that document is signed, no advice given through the site or in preliminary conversations should be relied upon as professional advice for any specific decision. Initial conversations are positioning and fit conversations.
No warranty for content accuracy
Content on the site (articles, frameworks, case studies, memos, work samples) is provided "as is" for informational and marketing purposes. We make no warranty, express or implied, about the accuracy, completeness, suitability, or fitness of any content for a particular purpose. Frameworks and patterns described on the site may not apply to your specific situation. Cite-and-verify before acting on any framework you find here.
To the maximum extent permitted by law, GAT disclaims all implied warranties including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.
Intellectual property
The site, its design, copy, structure, frameworks, code, images, and other content are owned by Guzman Applied Technologies or licensed to it, and are protected by U.S. and international intellectual property law.
You may:
- Read, link to, and share pages of the site for personal or professional purposes.
- Quote excerpts of articles or memos with attribution to Edwin Guzman / Guzman Applied Technologies and a link back to the source page.
You may not:
- Republish substantial portions of the site without written permission.
- Use site content to train commercial machine learning models without written permission.
- Remove copyright notices, brand marks, or attribution.
- Use the GAT name, logo, or wordmark in a way that suggests endorsement or partnership without written permission.
Third-party names, frameworks, and references cited on the site remain the property of their respective owners and are used for descriptive purposes only.
Acceptable use
When using the site, you agree not to:
- Submit false, misleading, or impersonating information through any contact form.
- Use the site to send spam, phishing attempts, or unsolicited commercial messages.
- Attempt to probe, scan, or test the vulnerability of the site or its hosting infrastructure without prior written authorization.
- Interfere with the site's operation, including by introducing malware or excessive automated traffic.
- Scrape the site for purposes that compete with GAT or that violate intellectual property rights.
Third-party links and services
The site links to and integrates with third-party services (Google Calendar for scheduling, LinkedIn, Notion, Vercel, Baxie, partner sites). Those services have their own terms and privacy policies, and we are not responsible for their content, terms, or practices. Use them at your own discretion.
Limitation of liability
To the maximum extent permitted by law, GAT and Edwin Guzman will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of the site, including lost profits, lost revenue, lost data, business interruption, or any reliance on site content. Total liability for any claim arising out of or related to the site, in the aggregate, will not exceed one hundred U.S. dollars ($100) or the amount you have paid us in the prior twelve months, whichever is greater.
This limitation does not apply to liability that cannot be limited by law (for example, gross negligence or willful misconduct under California law).
Indemnification
You agree to defend, indemnify, and hold harmless Guzman Applied Technologies and Edwin Guzman from any claim, demand, loss, liability, or expense (including reasonable attorney fees) arising out of your misuse of the site, your violation of these Terms, or your violation of any law or third-party right.
Privacy
Use of the site is also governed by our Privacy Policy, which explains what personal information we collect through the site and how we handle it.
Governing law and venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the site will be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.
This provision does not waive any non-waivable consumer-protection rights you may have under California or federal law.
Changes to these Terms
We may update these Terms from time to time. The "Effective date" and "Last updated" labels above reflect the current version. Continued use of the site after changes are posted means you accept the updated Terms.
Severability and entire agreement
If any provision of these Terms is held unenforceable, the rest will remain in force. These Terms, together with the Privacy Policy, constitute the entire agreement between you and GAT regarding use of the site. They do not replace or modify the terms of any signed engagement letter, scope of work, or other written agreement.
